The specific scope, deliverables, timelines, and fees for each engagement are defined in individual service agreements or statements of work executed between PlayerFlow Performance and the client. These terms supplement those agreements.
All content on the PlayerFlow Performance website, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software, is the property of PlayerFlow Performance or its content suppliers and is protected by international copyright and intellectual property laws.
For client projects, intellectual property ownership is governed by the terms of the applicable service agreement. Unless otherwise specified in writing, upon full payment of all fees, clients receive a license to use deliverables created specifically for their engagement. PlayerFlow Performance retains ownership of proprietary methodologies, frameworks, tools, and any pre-existing materials incorporated into deliverables. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website without prior written consent from PlayerFlow Performance.
To the maximum extent permitted by applicable law, PlayerFlow Performance and its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our website or services.
While we strive to deliver measurable results and employ data-driven strategies, marketing outcomes are inherently influenced by external factors including market conditions, regulatory changes, competitor activity, and platform algorithm updates. PlayerFlow Performance does not guarantee specific results, revenue figures, player acquisition numbers, or return on investment from any marketing campaign or strategy. Our total aggregate liability for any claims arising under these terms shall not exceed the total fees paid by you to PlayerFlow Performance in the twelve (12) months preceding the claim.
Either party may terminate a service engagement in accordance with the termination provisions set forth in the applicable service agreement or statement of work. In the absence of such provisions, either party may terminate with thirty (30) days written notice.
PlayerFlow Performance reserves the right to suspend or terminate access to our website and services at any time, without notice, if we reasonably believe you have violated these terms, engaged in fraudulent activity, or if your use poses a risk to the security or integrity of our systems. Upon termination, all outstanding invoices become immediately due and payable. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — shall remain in effect.
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which PlayerFlow Performance is incorporated, without regard to its conflict of law principles. Any disputes arising out of or relating to these terms or our services shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body in the governing jurisdiction. Each party shall bear its own costs and expenses in connection with such proceedings.
PlayerFlow Performance reserves the right to modify or update these Terms of Service at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify active clients via email. Your continued use of our website or services after any modifications constitutes acceptance of the updated terms. We encourage you to review this page periodically to stay informed of any changes. If you do not agree to the revised terms, you should discontinue use of our services and contact us to discuss your options.
